1This is an Application alleging discrimination in employment on the basis of race, colour, ancestry, place of origin, citizenship, ethnic origin, creed, and family status contrary to the Human Rights Code, R.S.O. 1990, c.H-19, as amended (the "Code"). A hearing was scheduled for July 19, 2010, commencing at 9:30 a.m. at the Tribunal's hearing centre, 655 Bay Street, Toronto, Ontario.
2Neither party was present at the hearing. In accordance with its usual practice, the Tribunal waited until 10:00 a.m. before proceeding.
3I am satisfied that both parties had notice of the hearing. In addition to the Confirmation of Re-Scheduled Hearing notice dated March 10, 2010, the Tribunal corresponded with the parties several times by mail and email in relation to the scheduling and re-scheduling of the hearing. A Case Assessment Direction dated March 25, 2009 was also sent to the parties. None of the documents which were mailed to the parties were returned to the Tribunal. The parties complied with the directions of the Tribunal which were set out in various pieces of correspondence. Neither party corresponded with the Tribunal by email or any other method to indicate that they could not attend the hearing as scheduled.
4In view of the non-attendance of both parties, the Application is dismissed.
