1In a previous Interim Decision, 2008 HRTO 449, the Tribunal deferred this Application pending the conclusion of a hearing before the Workplace Safety and Insurance Appeals Tribunal (WSIAT). WSIAT has now issued Decision No. 562/09, 2010 ONWSIAT 1200 and the proceeding before WSIAT is now concluded. The applicant has now filed a Request to proceed under Rule 14.3. The respondent has not replied to the Request and the time for doing so has passed.
2In the circumstances, the request to proceed is appropriate and is granted. Both parties have agreed to try mediation. The Registrar shall schedule the Application for a mediation session.
