1Following the Tribunal’s previous Interim Decision in this matter (2009 HRTO 1027), the Tribunal held a mediation which did not result in a resolution of the Application. Accordingly, the Application has now been scheduled for a hearing on the issue set out in that Interim Decision:
As a result of the division of powers between the federal and provincial governments, do the allegations made by the applicant fall under provincial jurisdiction and therefore under s. 1 of the Code?
2The Ontario Human Rights Commission filed a Request to Intervene seeking make submissions on this issue. The Request is unopposed. The Commission is granted to leave to intervene on the jurisdictional issue.
