1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, on November 4, 2009, and the respondent filed a Response on March 1, 2010.
2On May 11, 2010, a Tribunal Vice-chair spoke with the applicant by telephone. The applicant stated that he was in British Columbia and intended to withdraw his Application. The Vice-chair directed him to file a Request to Withdraw (Form 9) with the Tribunal.
3On June 10, 2010, the Tribunal sent the applicant a letter, which stated:

By June 17, 2010, please respond to this letter, in writing to the Registrar with a copy sent to the other party, and indicate your intentions with respect to this Application. If you wish to withdraw the Application, please complete the Form 9, send a copy of the Form 9 to the other party, and file it with the Tribunal along with the Statement of Delivery (Form 23)….
If you do not respond to this letter as directed by the specific date above, the Tribunal may deem you to have abandoned the Application and close the file.
4To date, the applicant has not contacted the Tribunal. In the circumstances, the applicant is deemed to have abandoned the Application. Accordingly, the Application is dismissed.
