1This is a Decision in respect of an Application filed on August 20, 2009 under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19 as amended, and (the Code”).
2On February 18, 2010, the respondent sent the Tribunal a letter advising that the applicant’s spouse had contacted the respondent to inform it that the applicant had died in January.
3On April 6, 2010, the Tribunal wrote to request that the applicant’s Executor contact the Registrar to indicate the Estate’s intentions with respect to the Application. No response was received, and the Registrar wrote again on May 5, 2010, referencing the previous letter and requesting a response by June 4, 2010. The letter advised that the Application could be dismissed as abandoned if the Executor did not respond.
4To date, there has been no response to the Tribunal’s letters.
5In the circumstances, the Tribunal deems the Application abandoned and it is accordingly dismissed.
