1The applicant seeks an adjournment (rescheduling) of the hearing scheduled for July 15, 2010, on the basis that he did not receive the Notice of Hearing and requires more time to prepare for the hearing. The respondent opposes the adjournment on the basis that it is eight months since the events in question, a rescheduling will cause further business interruptions, and there is the possibility that two of the respondent’s witnesses will be outside the province during the month of August. The respondent also states that one witness may move outside the province.
2The Tribunal’s records show that the Notice of Hearing was mailed to the alternate contact address listed on the Application and it was not returned to the Tribunal. The person to whom it was addressed has signed a statement saying he did not receive it.
3In all the circumstances, I have concerns about whether the applicant received appropriate notice and an adjournment is therefore granted. A notice rescheduling the hearing will follow from the Registrar’s office.
4To address the concerns raised by the respondent, the hearing will be rescheduled in September 2010 or later. If the witness has moved outside the province by the time of the hearing, his or her evidence may be heard by telephone.
