1This is an Application filed on April 1, 2010, under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”). This Interim Decision deals with the issue of whether the Application should be deferred pending the completion of a related grievance proceeding.
2The applicant states that the Application is part of another proceeding – a union grievance - that is still in progress. In the accompanying narrative, she describes that she has filed four grievances about the discrimination and harassment she experienced and attaches copies of the same (Case Nos. 2009-03, 2009-09, 2009-18 and 2010-01). The applicant requests deferral of the Application until the other proceeding is completed.
3On May 19, 2010, the Tribunal sent out the Application to the respondents and the affected union and sought submissions on the request to defer. The organization respondent agrees that the Application should be deferred. The other respondents and the union have not responded and the time for providing submissions has elapsed.
4Having regard to the material filed and the parties’ submissions, the Application will be deferred pending the conclusion of the proceeding in respect of the four grievances.
5The Tribunal directs the parties’ attention to Rules 14.3 and 14.4 which outline the procedure by which the Application may be brought back on after the conclusion of the proceeding in respect of the four grievances.
