1In a previous Interim Decision, 2009 HRTO 1980, the Tribunal deferred this Application pending the conclusion of arbitration proceedings. On April 22, 2010, the applicant filed a Request for an Order to proceed under Rule 14.3, on the basis that her grievance has been withdrawn without prejudice to her on-going Application before the Tribunal. The respondent has made no submissions, and the time for doing so has passed.
2In the circumstances, the request to proceed is appropriate and is granted.
3The applicant has indicated that she is willing to undertake mediation in respect of the Application. The respondent, which is represented by counsel, has not done so. Unless the respondent contacts the Registrar’s Office to indicate that it wishes to take advantage of mediation within seven days of the date of this Interim Decision, the Registrar shall schedule the Application for a hearing.
4I am not seized of this matter.
