HUMAN RIGHTS TRIBUNAL OF ONTARIO
B E T W E E N:
Shanmugalingam Venthan
Applicant
-and-
Milestone’s Restaurant
Respondent
DECISION
Adjudicator: Jay Sengupta
Indexed as: Venthan v. Milestone’s Restaurant
1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, (the “Code”), on January 21, 2010. The Application has not yet been sent to the respondent. The last incident of discrimination in the Application was alleged to have occurred on December 21, 2007.
2By correspondence dated April 16, 2010, the Tribunal informed the applicant that the Application appeared to be outside the Tribunal’s jurisdiction because it had been filed more than a year after the last incident of discrimination. The letter asked the applicant to file written submissions within 30 days to explain how the delay was incurred in good faith and why he believed no substantial prejudice would result to any person affected by the delay.
3The April 16, 2010 correspondence advised the applicant that if he did not respond within 30 days of the date of the correspondence, the Tribunal could deem the Application abandoned and close its file. The applicant has not responded to the Tribunal’s correspondence.
4In the circumstances, the applicant is deemed to have abandoned the Application.
5The Application is dismissed.
Dated at Toronto, this 9th day of June, 2010.
