HUMAN RIGHTS TRIBUNAL OF ONTARIO
B E T W E E N:
Ben Lam
Applicant
-and-
Hunter Amenities International Limited
Respondent
DECISION
Adjudicator: Jay Sengupta
Indexed as: Lam v. Hunter Amenities International
1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, (the “Code”), on February 25, 2010. The respondent has not yet been served with the Application.
2By correspondence dated April 23, 2010, the Tribunal advised the applicant that his Application appeared to be outside the Tribunal’s jurisdiction because it did not allege a ground or area of discrimination under the Code and, therefore, did not appear to raise an issue the Tribunal could resolve.
3The applicant was asked to provide written submissions within 30 days of April 23, 2010. The letter indicated that a failure to respond within the deadline could result in the Tribunal deeming the Application abandoned and closing its file. The applicant has not responded to the Tribunal’s correspondence.
4In the circumstances, the applicant is deemed to have abandoned the Application.
5The Application is dismissed.
Dated at Toronto, this 8th day of June, 2010.
