BACKGROUND

1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, (the “Code”), on November 22, 2008. He alleges discrimination in employment on the basis of disability. The respondent denies the allegations.

2The parties agreed to attempt mediation, which was scheduled for February 23, 2009. The mediation was then adjourned at the applicant’s request. The applicant was requested to provide the Tribunal with alternative dates, but never did.

3On May 10, 2010, the Registrar wrote to the parties directing the applicant to notify the Tribunal in writing of his intentions with respect to the Application within 10 days. No correspondence was received from the applicant.

4In the circumstances, it is apparent that the applicant has abandoned the Application. It is therefore dismissed.
