1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19 as amended (the “Code”), on January 21, 2009. The Tribunal sent the parties a Notice of Rescheduled Mediation dated December 23, 2009 scheduling a mediation for April 29, 2010.

2The applicant did not attend the April 29, 2010 mediation and did not communicate with the Tribunal to advise that she was unable to attend. A letter dated April 29, 2010 was issued by the Tribunal requesting that she advise the Tribunal of her intentions with respect to her Application. The Tribunal directed that she provide a response within 10 days, failing which “…the Tribunal will deem you to have abandoned the Application and close this file”.

3The applicant has not responded to the April 29, 2010 letter or otherwise communicated with the Tribunal.

4The Application is dismissed as abandoned, pursuant to Rule 5.4 of the Rules of Practice and the file is closed.
