INTERIM DECISION
Adjudicator: Jay Sengupta
Date: January 20, 2010
Citation: 2010 HRTO 129
Indexed as: Poirier v. Maclean Engineering
1This is an Application filed on August 7, 2009 under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19 as amended (the “Code”), in which the applicant alleged that he suffered reprisal in the area of employment. Initially, the applicant did not list any additional grounds although the Application documents included references to disability.
2In a previous Case Assessment Direction, the applicant was asked to confirm whether he intended to list disability as a ground of discrimination and to fill out the necessary supplementary forms. Although the applicant has not filled out any supplementary forms, he has sent in a detailed submission confirming that his Application does involve an allegation of discrimination on the basis of disability. In the circumstances, the Tribunal is satisfied that the Application is complete.
3Accordingly, the Application is amended to include discrimination on the basis of disability. The Application will be sent to the respondent, along with copies of the Case Assessment Direction and this Interim Decision.
4I am not seized.
Dated at Toronto this 20th day of January, 2009.
