10BThe applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), on February 24, 2010. The respondent has not yet been served with the Application.
21BBy correspondence dated April 29, 2010, the Tribunal advised the applicant that her Application appeared to be outside the Tribunal’s jurisdiction because it was filed more than a year after the last incident of discrimination described in the Application. The applicant was asked to explain how the delay was incurred in good faith and why she believed no substantial prejudice would result to any person affected by the delay within 30 days of April 29, 2010. The letter indicated that a failure to respond within the deadline could result in the Tribunal deeming the Application abandoned and closing its file. The applicant has not responded to the Tribunal’s correspondence.
32BIn the circumstances, the applicant is deemed to have abandoned the Application.
43BThe Application is dismissed.
