1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, (the “Code”), on February 25, 2009 and the respondent filed a Response on April 16, 2009.
2A mediation date was set for August 19, 2009. That date was cancelled at the request of the applicant’s counsel as the applicant had moved and counsel had been unable to contact him. The Tribunal has subsequently tried to contact the applicant but has not been successful in its attempts.
3By correspondence dated May 14, 2010, the Tribunal advised the applicant and his counsel that if he did not respond within 10 days of the date of the correspondence, the Tribunal would deem the Application abandoned and close its file. Neither the applicant nor his counsel has responded to the Tribunal’s correspondence.
4In the circumstances, the applicant is deemed to have abandoned the Application.
5The Application is dismissed.
