1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), on February 23, 2009, and the respondent filed a Response on April 16, 2009. As both parties agreed to mediation, the Tribunal scheduled a mediation date; however, the applicant did not attend at the scheduled time.

2By correspondence dated May 5, 2010, the Tribunal advised the applicant that she must advise the Tribunal of her intentions with respect to the Application. The applicant was also informed that if she did not respond within ten days of the date of the letter, the Tribunal would deem her to have abandoned the Application and close the file. The applicant has not responded to the Tribunal’s correspondence.

3In the circumstances, the applicant is deemed to have abandoned her Application.

4The Application is dismissed.
