[1] The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, (the “Code”), on December 9, 2008. A mediation was scheduled for March 27, 2009. The respondent attended, the applicant did not. Since then, the applicant has not corresponded further with the Tribunal.

[2] On March 30, 2009, the respondent wrote to the Tribunal to request that the Application be dismissed. By correspondence dated March 27, 2010, the Tribunal asked the applicant to state his intentions with respect to the Application, and advised that if he did not respond within 10 days of the date of the correspondence, the Tribunal would deem the Application abandoned and close the file. The applicant has not responded to the Tribunal’s correspondence.

[3] In the circumstances, the applicant is deemed to have abandoned the Application.

[4] The Application is dismissed.
