1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), on November 3, 2009, and the respondents filed a Response on December 17, 2009. As the parties indicated that they consented to mediation, the Tribunal attempted to schedule a mediation date.
2By correspondence dated March 26, 2010, the Tribunal indicated that the applicant had not responded to the Tribunal’s request for mediation dates and informed the applicant that he must advise the Tribunal of his intentions with respect to the Application. The applicant was advised that if he did not respond within ten days of the date of the correspondence, the Tribunal would deem him to have abandoned the Application and close the file.
3It also appears that the applicant indicated to Tribunal staff that he wished to withdraw his Application and was advised that he should then deliver a request to withdraw, in writing, to the respondents and file it with the Tribunal.
4To date, the applicant has not responded to the Tribunal’s March 26, 2010 correspondence, nor has he submitted a request to withdraw his Application in writing.
5In the circumstances, the applicant is deemed to have abandoned the Application.
6The Application is dismissed.
