1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, (the “Code”), on September 24, 2009 and the respondent filed a Response on January 26, 2010.
2On March 26, 2010, by way of an Interim Decision, 2010 HRTO 667, the Tribunal raised a jurisdictional issue on the basis that the corporate respondent appears to be federally regulated. The parties were directed to file submissions on the issue but none were received.
3On May 5, 2010, in a further Interim Decision, 2010 HRTO 988, the Tribunal ordered the applicant to indicate whether he intends to continue with his Application. He was advised that if he did not respond within ten days of the date of the correspondence, the Tribunal would deem the Application abandoned and close its file. The applicant did not file any submissions.
4On May 6, 2010, the respondent filed a Request for Order During Proceedings (RFOP) requesting that the Tribunal “close the file”.
5In the circumstances, the applicant is deemed to have abandoned the Application. The Application is dismissed.
