1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, (the “Code”), on July 16, 2009 and the respondents filed a Response on October 15, 2009.
2The matter was scheduled to be heard on June 11, 2010. That date was cancelled when the respondents requested that the hearing date be rescheduled due to a scheduling conflict. Although the parties were asked to provide available dates for the hearing, the applicant has not provided the Tribunal with any available dates as requested, nor has he otherwise contacted the Tribunal.
3On May 6, 2010, the Tribunal advised the applicant in writing that if he did not respond to the Tribunal within 10 days, the Tribunal would deem the Application abandoned and then close its file. The applicant has not responded to the Tribunal’s correspondence.
4In the circumstances, the applicant is deemed to have abandoned the Application.
5The Application is dismissed.
