1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, (the “Code”), on December 23, 2008 and the respondents filed their respective Responses on February 24, 2009 and April 21, 2009. The hearing in this matter was scheduled for February 1 and 2, 2010. On January 28, 2010, the applicant wrote an email to the Tribunal asking how he could “drop” his case. The hearing dates were cancelled.

2By correspondence dated May 4, 2010, the Tribunal advised the applicant that if he did not respond within 10 days of the date of the correspondence, the Tribunal would deem the Application abandoned and close its file. The applicant has not responded to the Tribunal’s correspondence.

3In the circumstances, the applicant is deemed to have abandoned the Application.

4The Application is dismissed.
