Josie Lucia v. Angela Santin, 2010 HRTO 1055

1This is an Application filed under s. 34 of the Human Rights Code, R.S.O. 1990, c.H.19 as amended (the “Code”). The Tribunal sent a Notice of Mediation, dated January 22, 2010, to the parties scheduling a mediation for May 19, 2010.

2Subsequent to sending the Notice of Mediation, the respondent advised the Tribunal that the parties had entered into terms of settlement. The Tribunal then sent a letter dated January 26, 2010 asking the applicant to send a completed Form 9 to the respondent. The applicant was given until February 5, 2010 to file her Form 9, failing which her file would be considered abandoned.

3The applicant has not filed her Form 9 or otherwise communicated with the Tribunal. In the circumstances, the mediation that was scheduled for May 19, 2010 is cancelled and the Application is dismissed.
