1This is an Application filed on October 14, 2008 under section 34 of the Human Rights Code, R.S.O. 1990, c. H.19 as amended (the "Code") in which the applicant alleges that his employer violated his rights to equal treatment with respect to employment without discrimination because of disability, race and ethnic origin.
2The Tribunal was advised that the applicant passed away and the Tribunal contacted the applicant's wife in November 2009 and January 2010 with respect to her intentions to proceed with the Application on behalf of her husband. The applicant's wife did not respond to the Tribunal's communications.
3The Tribunal also issued a letter dated April 6, 2010 to the estate trustee c/o the applicant's address seeking submissions from the estate trustee (and documents confirming its status as the estate trustee) on whether it wanted to continue with the Application. The Tribunal requested a response within 20 days and advised that if the estate did not respond, the Tribunal would deem the Application to be abandoned and the file would be closed. To date, the estate trustee has not responded.
4In the circumstances, given the failure of the applicant's wife and the estate trustee to respond to the Tribunal's communications, the Tribunal deems the Application to have been abandoned and the file is closed.
