1A hearing in this Application is scheduled for March 30, 2010. The respondents have raised a serious issue whether the estate of a deceased applicant may continue to pursue an Application alleging a breach of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, (the "Code").
2The parties have filed submissions on this issue and a decision is pending. In light of the significance of this issue, the Tribunal does not anticipate issuing a ruling prior to March 30, 2010.
3Accordingly, the hearing scheduled for March 30, 2010 is hereby cancelled and the deadlines for filing materials are also cancelled.
Evidence of Authority to Act on behalf of the Estate
4Should the Tribunal ultimately determine that it has authority to proceed, the Tribunal must be satisfied that the person who is attempting to continue an Application on behalf of a deceased person has authority to act on behalf of the deceased: Rowsell v. Johnson-Rose, 2009 HRTO 1580. The applicant's spouse is directed to provide the Tribunal with documents confirming his status to act for the estate of the applicant, such as a will appointing him as executor, within 30 days of the date of this Interim Decision.
