1This is an Application filed May 6, 2009 under section 53(5) of Part VI of the Human Rights Code, R.S.O. 1990, c. H.19 as amended (the “Code”). The corporate respondent and the personal respondents Mary Richardson and Ed Vergara have filed Responses seeking to have the Application dismissed or deferred on the basis of a parallel arbitration proceeding. In addition, the corporate respondent declines to accept delivery of the Application on behalf of the personal respondent Chris Leung on the basis that he is no longer employed by the corporate respondent. They also decline to disclose the contact information for the personal respondent Leung on the basis of privacy concerns.

2The corporate respondent is ordered to provide the Tribunal and the applicant with the last known mailing address for the personal respondent Chris Leung, within ten days of the date of this Interim Decision. The applicant, if he intends to pursue the Application against Chris Leung, is directed to deliver a copy of the Application to the personal respondent, within 20 days of receipt of the contact information from the corporate respondent, and file a statement of delivery (Form C) with the Tribunal and the other parties confirming that he has done so.

3The applicant is directed to file responding submissions on the respondents’ request for early dismissal or deferral in accordance within 20 days of receipt of this decision.

4The respondents shall file reply submissions, if any, within ten days of receipt of the applicant’s submissions.

5The Tribunal will issue further directions as required.
