INTERIM DECISION
Adjudicator: Ken Bhattacharjee
Date: June 26, 2009
Citation: 2009 HRTO 925
Indexed as: Segal v. Toronto (City)
[1] The purpose of this Interim Decision is to address the respondents’ request for an adjournment of the hearing scheduled for July 6, 2009.
[2] The respondents’ request is based on the fact that there is a strike at the City of Toronto, which makes it difficult for counsel for the City to communicate with several of the respondents and witnesses. The applicant opposed the request for an adjournment when the prospect of a strike was hypothetical, but recognized that if such a strike were to occur, she would respect any decision to adjourn the hearing, with the caveat that a case management meeting should be scheduled for July 6 in its stead.
[3] The respondents’ request for an adjournment is based on exceptional circumstances, and is therefore granted. The hearing on July 6 shall be turned into a case management meeting, at which only counsel for the parties are required to attend.
Dated at Toronto, this 26th day of June, 2009.
