1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), on March 19, 2009.
2The Application contains specific allegations against an instructor named “Ken”, and requests that the respondents provide Ken’s full legal name so that he can be added as an individual respondent.
3The respondents filed a Response on April 21, 2009, which identifies the individual in question as “Ken Dolan Soy”.
4The applicant filed a Reply and a Request for an Order during Proceedings on May 25, 2009. The Request for an Order requests that “Ken Dolan” be added as an individual respondent. The respondents filed a Response to a Request for an Order on June 5, 2009, which opposes the Request.
5There is no indication from any of the parties that the applicant’s Request for an Order was served on Mr. Dolan.
6The Tribunal therefore makes the following Orders:
(a) The Centre for Security Training and Management Inc. shall deliver to the applicant and file with the Tribunal the current or last known address of Mr. Dolan no later than five days after the date of this Interim Decision.
(b) The applicant shall serve on Mr. Dolan, file with the Tribunal and deliver to the respondents the Request for an Order during Proceedings no later than five days after receiving Mr. Dolan’s address.
(c) Mr. Dolan shall file with the Tribunal and deliver to the applicant and the respondents his Response to a Request for an Order no later than 14 days after receiving the Request.
