1This interim decision addresses the respondents’ request for an adjournment for the Case Resolution Conference scheduled for March 6, 2009. This date was selected after consultation with the parties.
2The respondents now indicate that they are no longer available on that date because they are in the process of preparing materials in support of requests to have the applicant’s representative removed from the record and to review the Tribunal’s Interim Decision, 2008 HRTO 403, refusing their motion to dismiss the Application under section 45.1 of the Code.
3The respondents’ motion was heard on November 21, 2008. At the conclusion of the hearing I ruled the request for early dismissal was dismissed with written reasons to follow. At that hearing the respondents raised concerns about the applicant’s representative.
4The respondents have had ample time since November 21, 2008 to file a request for order or make submissions on these matters. Other than stating their intention to do so, the respondents offered no explanation why they are not now available on the agreed Case Resolution Conference date.
5The applicant objects to the adjournment request.
6The Tribunal is committed to the fair, just and expeditious resolution of the merits of all transitional applications under section 53(3) and 53(5) and its processes are designed for timely resolution of these applications.
7In the circumstances, the request for an adjournment is denied.
