This is an Application alleging discrimination in housing on the grounds of association and reprisal contrary to the Human Rights Code, R.S.O. 1990, c. H.19, as amended, (the “Code”). A hearing was scheduled for June 1, 2009 commencing at 9:30 am at the Tribunal’s hearing centre in Toronto.
The applicant was not present at the hearing. In accordance with its usual practice, the Tribunal waited until 10:00 am before proceeding. The respondents asked that the Application be dismissed at that time.
I am satisfied that the applicant had notice of the hearing. The applicant has never advised the Tribunal of a change of address from the one which he provided in his Application. The Confirmation of Hearing notice was sent to that address. That notice was not returned to the Tribunal.
In view of the applicant’s failure to attend the hearing, the Application is dismissed.
Dated at Toronto, this 15th day of June, 2009.
