Adjudicator: David A. Wright
Indexed as: Crawford v. 2176534 Ontario
1This is an Application filed under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended. The respondent Harry Fine is a paralegal and the respondent Landlord Solutions is his registered business name. These respondents request the dismissal of the Application as against them on the basis that they have had no involvement in any of the matters giving rise to the Application. They note that the applicant’s narrative makes no reference to them. The applicant did not file any Reply and has not addressed these respondents’ submissions, nor made factual allegations against them.
2In light of the fact that the narrative makes no reference to Landlord Solutions and Harry Fine and they state that they have no involvement in the matter, the applicant must provide submissions explaining why they should remain as named respondents by June 29, 2009. Should the applicant fail to do so, these respondents shall be removed as respondents and the style of cause amended accordingly.
3Harry Fine and Landlord Solutions seek costs. Their attention is directed to the Tribunal’s decision in *Dunn v. United Transportation Union, Local 104*, 2008 HRTO 405. If they still intend to seek costs, they should file full argument outlining the basis on which they submit that the Tribunal has jurisdiction to award costs by June 29, 2009.
4I am not seized.
Dated at Toronto, this 15th day of June, 2009.
