Respondent
INTERIM DECISION
Adjudicator: Michelle Flaherty
Indexed as: Macdonald v. Toronto District School Board
1The applicant, an elementary school teacher with the respondent, the Toronto District School Board (“TDSB”), filed an Application pursuant to s. 34 of the Human Rights Code, R.S.O. 1990 c. H.19, as amended (the “Code”), alleging that the respondent discriminated against him on the basis of disability and engaged in reprisals in respect of employment during the period from 2004 through 2008. Among other things, the applicant asserts that he experienced discrimination in scheduling, discipline, comments, and in being denied necessary accommodations in the workplace.
2On May 1, 2009, the applicant filed a Request for an Order (“Request”) seeking to amend the Application to add further details in support of his allegations and to make editorial changes.
3The respondent has not responded to the Request and the time for doing so has elapsed.
4In view of the stage at which this Request to amend is made, the nature of the amendments and the absence of any apparent prejudice, I see no reason to deny the applicant’s Request. I order that the Application be amended accordingly.
5The respondent may file an amended Response within 20 days this Interim Decision.
6I am not seized of this matter.
Dated at Toronto, this 10th day of June, 2009.
