1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, on February 26, 2009. The Application alleges discrimination in services and names as the respondent Complex Services Inc. o/a Fallsview Casino Resort. The subsequently filed Response states that the respondent has been incorrectly named because Complex Services Inc. is responsible for human resources and staffing at the casino. The Response indicates that Falls Management Group L.P. is the full name of the organizational respondent. This information led the applicant to file a Request for an Order During Proceedings seeking to add Falls Management Group L.P. as a respondent. The Response to a Request for an Order confirms that Falls Management Group L.P. operates the casino, and consents to it being added as a party.
2Based on the material before me, and as it appears that the parties do not dispute that Falls Management Group L.P. is the proper respondent to this Application, I order that Falls Management Group, L.P. be added as a respondent, and that Complex Services Inc. o/a Fallsview Casino Resort be removed as a respondent. The style of cause in this matter is hereby amended with this interim decision.
3The applicant also seeks to add “Ontario Lottery and Gaming Corporation o/a Niagara Fallsview Casino Resort” as a respondent. However, the Ontario Lottery and Gaming Corporation has not been sent a copy of her Request for Order. The applicant must deliver her Request for Order During Proceedings (Form 10) to this proposed respondent so that it might respond. The applicant is also reminded to file a Statement of Delivery confirming that the above proposed respondent has been sent the Form 10.
