1This is an Application filed on February 6, 2009 under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19 as amended (the "Code"). The purpose of this Interim Decision is to consider a Request to Intervene filed by the Canadian Union of Public Employees (CUPE).
2The name of the respondent is amended in accordance with the information provided in the Response.
3The Application alleges discrimination in employment on the basis of disability. The applicant was, until the termination of his employment, represented in his employment relations by CUPE. According to the information in the Response, CUPE filed a grievance disputing the applicant's dismissal, but withdrew the grievance before arbitration.
4It appears that the applicant also filed a complaint with the Ontario Labour Relations Board against the union, which he has withdrawn.
5The union states that it wishes to address the issues of remedy, whether obtained through settlement or by order of the Tribunal, and any other issue which may arise in regard to the Application that may impact upon the collective agreement between CUPE and Maple Health Centre-York Region. The Tribunal is satisfied that the union has an interest in the issues raised by the Application. The Request to Intervene is granted. The extent and nature of the union's participation at the hearing will be determined by the Vice-Chair assigned to hear the Application.
