INTERIM DECISION
Adjudicator: David A. Wright
Date: June 3, 2009
Citation: 2009 HRTO 748
Indexed as: Degen v. Toronto (City)
[1] The applicant asks for an adjournment of this matter, in which a hearing is scheduled on July 2, 2009. He has made a complaint to the Law Society of Upper Canada (“LSUC”) against counsel for the one of the respondents. He states that his complaint alleges a conflict of interest and affects whether counsel can represent her client. The respondents do not oppose adjournment.
[2] In my view, these are exceptional circumstances that justify the adjournment. Accordingly, the hearing on July 2, 2009 is hereby cancelled. The Tribunal shall take no further steps in this matter for a period of up to one year unless contacted by one of the parties. If the applicant does not communicate with the Tribunal by June 3, 2010, the Application may be dismissed as withdrawn.
[3] I am not seized
Dated at Toronto, this 3rd day of June, 2009.
