1This is an Application filed March 20, 2009 under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the "Code"). This Interim Decision addresses the issue of the proper name and contact information of two individual respondents whom the applicant wishes to add as parties.
2The applicant made a Request for an Order During Proceedings asking that the Tribunal order the respondent to provide the names of the driver and supervisor with whom the applicant interacted on July 2, 2008 and who were involved in the alleged discriminatory incidents that form the basis of the Application.
3The respondent has not filed a Form 11 in response to the Request for Order and the time for doing so has now passed. In its Response to the Application, the respondent did provide the name of an individual whom it understands to be the driver involved, but did not provide the name of the supervisor.
4Under Rule 1.7(p) of the Tribunal's Rules of Procedure, the Tribunal may require a party to produce information in order to provide for the fair, just and expeditious resolution of a matter before it. In order to enable the Application to be sent to the individual respondents identified in the narrative of the Application and whose names are sought in the Request for Order During Proceedings, I order AAA Best Choice Taxi Inc. to provide the applicant and the Tribunal with the correct names and contact information of the driver and supervisor with whom the applicant interacted on July 2, 2008. If the respondent is unable to provide a current address, it is ordered to provide the Tribunal with the most recent addresses for the individuals. This information must be provided to the applicant and Tribunal by June 15, 2009.
