INTERIM DECISION
Adjudicator: David Muir Date: May 25, 2009 Citation: 2009 HRTO 677 Indexed as: Bayne v. OPSEU Local 520
Reasons for Decision
1These are two Applications filed under section 53(3) of Part VI of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”).
2The Tribunal’s Rules of Procedure for Transitional Applications are to be interpreted and applied in a way that ensures a fair, just and highly expeditious process for the determination of these Applications.
3These Applications involve similar facts and appear to raise similar legal issues. Accordingly, I find that in order to ensure a fair, just and highly expeditious process for their resolution, these Applications should proceed together for the purposes of mediation.
4The mediation scheduled to take place on May 15, 2009 in T-0665-08 was adjourned on consent of the parties to June 29, 2009 at 9:30 a.m. when mediation in T-0733-08 has been scheduled.
5The parties are also agreed to an amendment of the name of the corporate respondent in T-0665-08. Pursuant to the parties agreement the style of cause in T-0665-08 is amended to reflect the correct name of the corporate respondent, OPSEU.
6I am not seized of these matters.
Dated at Toronto, this 25th day of May, 2009.
