Reasons for Decision
1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the "Code"), on September 4, 2008.
2The Tribunal sent the parties a Confirmation of Hearing by regular mail on February 6, 2009. The Confirmation of Hearing informed the parties that the Tribunal had scheduled a hearing of the Application on May 14 and 15, 2009 at 655 Bay Street, 14th Floor, Toronto, Ontario commencing at 9:30 AM. It was sent to the parties at the addresses that they specified in the Application and the Response to the Application, and was not returned to the Tribunal. Furthermore, neither party complied with the disclosure requirements in Rules 16 and 17 of the Tribunal's Rules of Procedure.
3On May 8, 2009, the Tribunal sent the parties a Case Assessment Direction ("CAD") at the e-mail addresses that they specified in the Application and the Response to the Application. The CAD reminded the parties that the hearing was scheduled for May 14 and 15, 2009.
4Neither party attended the hearing at the date, time and place that was set out in the Confirmation of Hearing nor has the Tribunal received communication from either of them since that time.
5I am satisfied that the applicant received notice of the hearing, but has decided to abandon his Application. Accordingly, the Application is dismissed.
