Human Rights Tribunal of Ontario
B E T W E E N:
Donovan Rodriques Applicant
-and-
Olameter Inc., Brian Yeoman and Robbert Moriarity Respondents
INTERIM DECISION
Adjudicator: David A. Wright Date: May 14, 2009 Citation: 2009 HRTO 638 Indexed as: Rodriques v. Olameter
1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, alleging discrimination in employment on various grounds by the organization respondent, including in being dismissed from employment. He requests that the Application be expedited.
2The applicant’s arguments in support of his Request to Expedite focus on the financial hardship caused by his loss of income on his family and the stress of the events and of being out of work. While I do not doubt the difficulties the applicant is experiencing, the Tribunal has held in numerous cases that these types of factors alone do not constitute indications of urgency as compared with other employment dismissal cases that justify expedited proceedings: see, for example, Weerawardane v. 2152458 Ontario Ltd., 2008 HRTO 53. Accordingly, the Request to Expedite is dismissed.
3The Tribunal notes that the parties have agreed to mediation. Mediation will be scheduled as soon as possible.
4I am not seized.
Dated at Toronto, this 14^th^ day of May, 2009.
