INTERIM DECISION
Adjudicator: David A. Wright
Indexed as: Yu v. O’Neill Centre
1The applicant asked that this Application be expedited, citing the serious stress and emotional effects of what she alleges is harassment contrary to the Human Rights Code, R.S.O. 1990, c. H.19, as amended. Having reviewed the materials, I cannot conclude that this Request to Expedite meets the high threshold required by the Tribunal’s jurisprudence: see Weerawardane v. 2152458 Ontario Ltd., 2008 HRTO 53. In particular, without questioning the sincerity of the applicant’s description of her feelings, there is no evidence that a particularly rapid hearing would assist in alleviating her symptoms. The Request to Expedite is denied. The Tribunal notes that the parties have agreed to mediate, and a mediation will be scheduled at an early date.
Dated at Toronto, this 29th day of April, 2009.
