1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, (the “Code”), on July 14, 2008, and the respondent filed a Response on August 26, 2008. Although both parties indicated that they agreed to attend mediation, the applicant has not provided the Tribunal with an available date for mediation, as requested by the Tribunal, nor has she otherwise contacted the Tribunal since filing her Application.

2By correspondence dated March 6, 2009, the Tribunal advised the applicant that if she did not respond within 10 days of the date of the correspondence, the Tribunal would deem her to have abandoned the Application and the file would be closed. The applicant has not responded to the Tribunal’s correspondence.

3In the circumstances, the applicant is deemed to have abandoned her Application.

4The Application is dismissed.
