1This is an Application filed September 5, 2008 under section 53(5) of Part VI of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”).
2This Interim Decision addresses the applicant’s request for an adjournment for the Case Resolution Conference scheduled for March 10, 2009.
3On February 4, 2009, the applicant sought to add additional allegations of reprisal and harassment to the Application and sought production of various documents from the respondent. On February 16, 2009, the respondent indicated that they opposed the request to expand the subject matter of the Application and on February 18, declined to produce the requested documents. On February 18, 2009, the applicant requested an adjournment in light of the disputed requests above.
4On February 20, 2009, the parties were advised that the request for adjournment was denied with reasons to follow.
5In my view, the contested preliminary requests can be dealt with at the commencement of the Case Resolution Conference and doing so will not interfere with the scheduled hearing. In the circumstances, there is no need to adjourn the hearing.
