1On October 31, 2008, the applicant filed an Application pursuant to s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended,(the “Code”), in which he alleges that the respondents violated his right to equal treatment with respect to services without discrimination.
2There are ongoing child protection proceedings before the Ontario Court of Justice under the Child and Family Services Act, R.S.O. 1990, c. C.11, as amended. The applicant argues that the commencement of those proceedings was discriminatory. The respondent Children’s Aid Society of Toronto asks, among other Requests, that this Application be deferred pursuant to Rule 14 of the Tribunal’s Rules of Procedure, pending the completion of the proceedings before the Ontario Court of Justice.
3The Tribunal will consider the Request that the Application be deferred pending the conclusion of the child protection proceedings. The respondents may deliver to the parties and file with the Tribunal submissions on this issue by March 16, 2009. The applicant may deliver to the parties and file with the Tribunal any Response by March 23, 2009. The respondents may deliver to the parties and file with the Tribunal any Reply by March 30, 2009.
