1Kevin Law, the applicant, filed his Application on June 3, 2009, under section 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”). By Interim Decision dated August 26, 2009, 2009 HRTO 1323, the Tribunal considered the fact that there were four related grievances and deferred the Application “pending the conclusion of the grievance.” On October 21, 2009, the applicant requested that his Application proceed as the respondent has denied the related grievances at Step 2 of the grievance process and he will not know for a few months if the union will be proceeding to arbitration. The respondents and union have not responded to the applicant’s request.
2Having regard to the information provided, there is no indication that the grievances have been concluded and accordingly, the applicant’s request to proceed at this time is denied. The Tribunal’s earlier decision governing the status of the Application remains in effect.
