INTERIM DECISION
Adjudicator: Sherry Liang Date: December 21, 2009 Citation: 2009 HRTO 2238 Indexed as: Macanovic v. Toronto Police Services Board
1In this complaint made under the Human Rights Code, R.S.O. 1990, c. H.19 as amended (the Code), the complainant has filed Requests for an Order During Proceedings dated October 30, 2009 and December 3, 2009. In these Requests, she seeks production of additional documents, as well as certain information. The Chief of Police has responded to these Requests by correspondence dated November 26, 2009 and December 16, 2009, attaching some of the documents requested, and providing explanations with respect to other aspects of the Requests.
2The Toronto Police Services Board (the Board) states that the documents requested are not in its possession or control.
3The Emergency Medical Services (EMS) of the City of Toronto, represented by counsel for the Board, has also provided disclosure of one of the documents requested.
4Having regard to the material before it, the Tribunal makes no direction for additional production at this time. The Tribunal has, on this date, received an additional Request from the complainant in which she seeks to provide oral submissions on her request for further disclosure through a conference call. The Tribunal declines the request for a conference call hearing. Any outstanding issues arising out of the Requests may be addressed at the hearing of this matter.
Dated at Toronto, this 21st day of December, 2009.
