1The Registrar wrote to the parties on January 6, 2009 as follows:

The Tribunal is writing in response to correspondence dated December 19, 2008 from counsel for the respondents, attaching e-mail communications with counsel for the applicant evidencing the applicant’s intent to withdraw his Application.

The Tribunal will issue an order confirming the withdrawal and finally disposing of the Application unless it hears from the applicant by no later than January 13, 2009 as to why this Application should proceed notwithstanding the Full and Final Release.

2The applicant has not responded to date.

3The Application filed September 19, 2008 under section 53(3) of Part VI of the Human Rights Code, R.S.O 1990, c. H.19, as amended, is withdrawn with leave of the Tribunal.
