1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, alleging discrimination with respect to employment on the grounds of race, place of origin, ethnic origin, and age. The respondent filed a Response, and there has been an Interim Decision, 2009 HRTO 1100). A mediation was scheduled for November 10, 2009. The parties were notified of the mediation, by letter of September 4, 2009, sent to the addresses they had given the Tribunal.
2The applicant did not attend mediation, or contact the Tribunal. In accordance with its usual practice, the Tribunal sent a letter to the applicant on November 16, 2009, informing the applicant that she was required to advise the Tribunal of her intentions within 10 days of the date of the letter or the Tribunal would deem her to have abandoned the Application.
3Neither letter was returned to the Tribunal. To date, the applicant has not communicated with the Tribunal. In the circumstances, the applicant is deemed to have abandoned the Application. Accordingly, the Application is dismissed.
