1This is an Application filed on October 20, 2008, under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19 as amended (the "Code").

2A mediation date scheduled for March 6, 2009, was cancelled at the request of the respondent. Since then, attempts have been made by the Tribunal to reschedule the mediation.

3In a Registrar's letter dated April 16, 2009, the applicant was directed to advise the Tribunal within 10 days of the date of the letter whether he wished to proceed with his Application. The letter stated that if the applicant did not do so, the Application would be deemed abandoned.

4The applicant contacted the Tribunal and indicated he would be in touch with available dates after September, 2009.

5In a second Registrar's letter dated October 26, 2009, the applicant was directed to advise the Tribunal within 10 days of the date of the letter whether he wished to proceed with his Application. The letter stated that if the applicant did not do so, the Application would be deemed abandoned. A voice mail message was left on the applicant's phone and an email was sent to him on November 17, 2009.

6The applicant has not communicated with the Tribunal as directed in the letter from the Registrar. The Application is dismissed as abandoned.
