1This is an Application alleging discrimination on the basis of disability in housing, contrary to the Human Rights Code, R.S.O. 1990, c. H.19, as amended, (the “Code”). A hearing was scheduled for November 2, 2009, commencing at 9:30 am at the Tribunal’s hearing centre in Toronto.
2The applicant was not present at the hearing. In accordance with its usual practice, the Tribunal waited until 10:00 am before proceeding. The respondent submitted that the Application should be dismissed as there is “no case”.
3I am satisfied that the applicant had notice of the hearing. In addition to the Confirmation of Hearing notice, the Tribunal issued a Case Assessment Directions in this matter. Neither of these documents were returned to the Tribunal.
4In view of the applicant’s non-attendance, the Application is dismissed.
