1This is an Interim Decision to deal with a Request for an Order During Proceedings (RFOP), and to give some case direction.
2Two applications have been filed by this applicant, under section 34 of the Ontario Human Rights Code, R.S.O. 1990 c. H.19, as amended, (“the Code”). Tribunal file number 2009-01581-I, filed on April 22, 2009, alleges that the applicant’s union and a fellow union member discriminated against the applicant in respect of membership in a vocational association on the basis of sex, and engaged in reprisals contrary to the Code. Tribunal file number 2009-03214-I, filed on August 12, 2009, alleges that the applicant’s employer discriminated against the applicant in respect of employment on the basis of sex, and engaged in reprisals contrary to the Code.
3Tribunal file number 2009-01581-I has been the subject of a mediation; Tribunal file number 2009-03214-I has not, as it was filed later.
4The RFOP, filed in respect of Tribunal file number 2009-01581-I, and served on all of the parties to both Applications, requests that the two matters be heard together. The applicant has consented to this request, subject to no further delay in the scheduling of hearing dates. The respondent in Tribunal file number 2009-03214-I has not responded to the RFOP, and the time for doing so has expired.
5In the circumstances, and on my review of the material in the files, it appears reasonable that the two Applications be heard together. The Registrar shall schedule a hearing as soon as possible. The parties to Tribunal file number 2009-03214-I have consented to mediation; the Registrar is requested to set a date for mediation without delaying setting the date for the hearing.
6I am not seized.
