Citation: 2009 HRTO 192
Indexed as: Stead v. Trehaven Golf & Country Club
[1] This is an Application filed October 7, 2008 under section 53(3) of Part VI of the Ontario Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”).
[2] This Application is proceeding to a Case Resolution Conference on April 21 and 22, 2009. The respondents have requested that the Tribunal issue an order to protect the confidentially of the business records of the corporate respondent. For example, they request an order that documents are to be kept confidential among the parties, that no copies be made except for the purpose of the hearing, that the documents not be disclosed to other parties except for the purpose of the litigation, and that all but one copy be returned to the respondents upon completion of the proceedings. The applicant disputes the necessity of these orders.
[3] The Notice of Case Resolution Conference advises parties that materials disclosed may not be used for any purpose other than these proceedings.
[4] There are no submissions to support the conclusion these documents need be subject to greater protection from disclosure than presently in place. In the circumstances, the Tribunal declines to issue the orders requested.
Dated at Toronto, this 27th day of February, 2009.
